The Right To Bring A Claim For Compensation for Human Rights Injuries...


This right includes the ability to recover monetary compensation, to insist on a proper and full investigation of the incident, and to see the perpetrators of the abuses brought to criminal justice. The obligation to meet these responsibilities extends to a successor government to the same degree that it applied to the former government that undertook or tolerated the human rights abuses.
The Universal Declaration of Human Rights says that "Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law...

The International Covenant on Civil and Political Rights, which has been ratified by more than 140 countries, including the United States, says that "Each State Party to the present Covenant undertakes: (a) To insure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the violation has been committed by person acting in an official capacity...."
